Occasionally, Create Now! sends broadcast e-mails to our supporters in order to update them regarding our events and activities. According to the CAN-SPAM Act of 2003, Section 3, Sub-section 2(a), the e-mail broadcasts sent by Create Now! are not considered spam.
(2) COMMERCIAL ELECTRONIC MAIL MESSAGE.
(A) IN GENERAL.The term commercial electronic mail message means any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service (including content on an Internet website operated for a commercial purpose).
We are not a commercial entity, and our e-mail never contains commercial advertisement or promotion of a commercial product or service. They simply contain announcements and information about our activities and events.

As a non-profit organization providing mentorship in the arts to at-risk and high-risk children and youth, we are committed to maintaining a mailing list that offers choices about inclusion. All users included in our mailing list have either asked us to keep them informed of our activities, or have been recommended to us as having an interest in aiding at-risk youth through the use of the arts and creative activities.
To that end, we have implemented this Anti-SPAM policy to:
- Help prevent our identity from being used to send unsolicited emails or email campaigns.
- Respond to complaints about use of our web site and e-mail servers as a vehicle to send unsolicited email.
- Clarify our use of permission-based email communication practices.
- Ensure we are in compliance with the requirements of the 2003 CAN-SPAM Act.
Our Policy
We have zero tolerance for Unsolicited Commercial Email (a.k.a. SPAM or UCE) that is in any way associated with our organization or our partners. Examples of behavior that we consider to be in viloation of our Anti-SPAM Policy include, but are not limited to:
- Sending or employing a third party to send informational email messages about our organization to people who have specifically requested NOT to receive such emails.
- Forging of information campaign email message headers to hide the identitiy of the true originator of the email message.
- Harassment, whether through language, frequency, or size of informational email messages.
- Any bulk emails sent without valid unsubscribe links or that in any other way do not comply with the requirements of the 2003 CAN-SPAM Act.
Our definition of UCE does not include sending information email messages to employees, volunteers, mentors, business partners, sponsors, students, or any other group that we communicate with on an ongoing or regular basis.
Examples of behavior that we consider to be acceptable include:
- Renting lists from third-parties who assure opt-in or double opt-in inclusion, and where the service providers have provided clear opt-out or unsubscribe opportunities.
- Using opt-in or double opt-in lists our partners may develop or have developed on our behalf for newsletters, newsgroups, or user groups.
- Manually collecting published addresses explicitely allowing or requesting business- or category-related contact, such as categorized directories or web site "contact us" pages
The following sources of email lists for our use are NOT acceptable and not used by us:
- Lists generated with web spiders.
- Email addresses collected from discussion lists or newsgroups.
- Lists generated with email address collector programs.
Generally speaking, any email list created in a way that does not offer a choice about inclusion is considered a SPAM list and is never sent by us.
